Terms of Service

By creating an account or using Awwpals ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all users, including individuals, rescue organizations, breeders, and brand accounts. Additional terms may apply to organization and brand accounts.

You must be at least 13 years old to use Awwpals. By using the Service, you represent that you meet this requirement.

If you are between 13 and 18 years old, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete registration information
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorized use of your account
• Not create multiple accounts to evade restrictions or bans

We reserve the right to suspend or terminate accounts that violate these Terms.

SMS Communications: By providing your phone number during registration, you consent to receive a one-time SMS verification code from Awwpals. Message and data rates may apply. Message frequency varies based on your verification requests. Reply STOP to any message to opt out. Reply HELP for support. Carrier discounts do not apply to messages received through this program. Your mobile information, including your phone number and messaging consent, will not be shared with third parties or affiliates for marketing or promotional purposes.

You retain ownership of content you post on Awwpals ("User Content"). By posting User Content, you grant Awwpals a non-exclusive, worldwide, royalty-free, sublicensable license to use, copy, modify, distribute, and display that content in connection with operating and improving the Service.

You represent that you have the right to post any content you submit, and that your content does not violate the rights of any third party.

You agree not to post, share, or transmit content that:

• Is illegal, including child sexual abuse material (CSAM) -- violations are reported to NCMEC and law enforcement
• Harasses, bullies, or threatens other users
• Impersonates any person or entity
• Contains spam, malware, or phishing attempts
• Violates the intellectual property rights of others
• Is false, misleading, or deceptive
• Promotes self-harm or violence

You also agree not to:

• Scrape, crawl, or automate access to the Service
• Reverse engineer any part of the platform
• Circumvent security features or access controls
• Use the Service for commercial purposes without our consent

Rescue organizations and breeders must complete our verification process before being permitted to list animals for adoption. Verified organizations agree to:

• Provide accurate information about animals listed
• Respond promptly to adoption inquiries
• Comply with all applicable animal welfare laws
• Not list animals from unlicensed sources

We reserve the right to remove any organization account that misrepresents animals or violates applicable laws.

Awwpals is a platform that connects adopters with rescue organizations and breeders. We do not guarantee the health, temperament, or suitability of any animal listed on the platform.

All adoption agreements are between the adopter and the organization or individual listing the animal. Awwpals is not a party to any adoption transaction and assumes no liability for outcomes of adoptions facilitated through the platform.

The Awwpals name, logo, design, and all related trademarks and service marks are owned by Awwpals and may not be used without our prior written permission.

The platform itself, including its code, features, and content created by Awwpals, is protected by copyright and other intellectual property laws.

Awwpals complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We respond expeditiously to valid copyright infringement notices and maintain a policy of terminating repeat infringers' accounts.

To report copyright infringement: Send a written notice to dmca@awwpals.com containing all elements required by 17 U.S.C. § 512(c)(3): your signature, identification of the copyrighted work, location of the infringing material, your contact information, a good faith belief statement, and an accuracy statement under penalty of perjury.

Counter-notification: If your content was removed and you believe it was removed in error, you may file a counter-notification under 17 U.S.C. § 512(g)(3). Contact dmca@awwpals.com for instructions.

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

We may suspend or terminate your account at any time, with or without cause, including for violations of these Terms. You may delete your account at any time through the Settings menu.

Upon termination, your right to use the Service ceases immediately. We may retain certain information as required by law or for legitimate business purposes, as described in our Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

TO THE FULLEST EXTENT PERMITTED BY LAW, AWWPALS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in California.

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
